1. As a Client communication agent:
1.1 In the context of services such as AML and KYC assistance, the entity performs the maintenance of confidential documents, in the form of electronic data, from clients of credit institutions, PFS, payment institutions, “electronic money institutions, insurance undertakings, reinsurance undertakings, contributors, members or beneficiaries of pension funds and investors in UCIs, SIFs, investment companies in risk capital.
2. As an Administrative agent of the financial sector for the clientele:
2.1 In the context of the services for automatic exchange of information, the entity, on behalf of reporting financial institutions does:
i) the generation of the xml reports required for Mandatory Disclosure Regime (MDR), CESOP, CARF, FATCA and CRS declarations; and
ii) the filing of CESOP, CARF, FATCA and CRS declaration to the local tax authorities.
2.2 In the context of the filing of fund financial statements, the preparation and filing of statistic reports to the CSSF and BCL, the entity assists Board of Directors/Central Administration/Investment Funds/AIFM in
i) the filing of the financial statements to the CSSF;
ii) the filing of statistical reporting to BCL; and
iii) the filing of statistical reporting to the CSSF.
3. As a service provider for the reporting of cross-border arrangements, i.e. ‘Mandatory Disclosure Regime’ (MDR), the entity identifies and logs the reportable cross-border arrangements by using a dedicated MDR tool.
4. As Secondary IT systems and communication networks operator of the financial sector:
4.1 The PFS intends to provide outsourcing solutions for the financial sector based on secondary IT systems and communication networks in the area of archiving/hosting services with secure data storage and transfer, reporting, tool based tax services, develop or implement and maintain information and systems and communication networks, dematerialization, processing and back-up of financial sector entities and perform any other related activities as permitted by Art 29-4 of the law of April 5, 1993 on the financial sector, as amended.
4.2 Data, processing, workflow and extraction services, consisting in, upon reception of external requests for stored data, and delivering reporting including added value analysis services.
4.3 Providing processing, liquidation, cyber services and other tool-based services, such as but not limited to, infrastructure information, solutions, support and administration services.
5. As a service provider of Tax Reclaim services:
5.1 In the context of eligibility analysis, the entity collects financial information regarding taxpayer's income and computes withholding taxes (WHT) amount to reclaim based on EU law, double tax treaties or national law.
5.2 In the context of the preparation of the tax reclaims, the entity gathers financial and identification information regarding the taxpayer and complete tax reclaims form. The entity collects documents, reconciles, and prepares the reclaim package file for the competent tax authorities.
5.3 In the context of post-filing activities, the entity ensures follow-up on any further queries, questions or need of information from the competent tax authorities.
6. NAV computation:
The entity provides funds and SPV accounting as well as ancillary related services.
